Under the agreement, Pfizer will pay $50 million to resolve the claims, which it claims includes claims of delayed stomach acid production in the heart. According to the agreement, the plaintiffs allege the company’s acid-suppressing drugs were not effective or safe enough to cause serious heartburn and acid reflux symptoms.
“Pfizer has been trying to get the money through the courts to bring this dispute to trial,” said U. S. District Judge James M. Alperman in a news release. “This settlement is critical to protecting the rights of these people.”
Nexium is an acid-reducing drug for heartburn. The drug treats acidity, or burning sensation, caused by stomach acid. It is used to treat patients with heartburn and other acidity-related symptoms.
Under the agreement, Pfizer will pay $50 million to resolve the claims in a multidistrict litigation (MDL). The settlement will allow the plaintiff to receive the full amount of the settlement unless the court rules otherwise.
The plaintiffs also are seeking a refund of $20 million to compensate the manufacturer of Nexium for any portion of the settlement, as well as a $15 million settlement from the company, and an injunction to prevent the company from selling the drug. The company is also seeking to enforce the agreement’s terms and the parties’ intent to pay the $50 million.
Pfizer has not responded to media queries for comment.
